ICE has stepped up questioning at airports lately. For many people the problem isn't that they don't know their rights. It's thatthe words won't come out in the moment. You're nervous, your English locks up, the officer talks fast, and the seconds are gone.
This article does exactly one thing: it writes out the four things you need to say, so you can memorize them or keep them on your phone and read them off.
📌 1. Assert your rights and ask for your lawyer
This is the single most important line. Look at the officer and say these two sentences clearly:
"I am exercising my right to remain silent. I want to speak to my lawyer before answering any questions."

📌 2. Hand over your documents (when cooperating with document checks)
As you hand over the printed copies of your passport, I-94, and I-485 receipt, say:
"Here are my identity and status documents. I wish to remain silent and contact my attorney."

📌 3. If they press you to sign something or answer details
No matter what they say, repeat this one line, andnever sign anything：
"I will not answer questions or sign anything without my attorney present."

📌 4. Ask whether you're free to leave (if stopped outside the security area)
"Am I free to go?"

- If the officer says "Yes": walk away calmly and quietly.
- If the officer says "No": go back to phrase one: you want your lawyer and you're staying silent.
⚠️ One difference that really matters: where in the airport you are
The phrases above are forinterior enforcement situationsFor example, if you have already entered the country but get stopped by ICE near the terminal hall, baggage claim, or check-in counters, exercising your right to remain silent and asking for a lawyer are both completely legal in this situation.
But if youjust got off the plane and are still at CBP inspection (primary / secondary inspection), the situation is different:
- Inspection is part of "seeking admission," and at this stage non-citizenshave no right to have a lawyer present
- Refusing to answer the inspecting officer's questions can lead tobeing denied entry, removed, or having your visa revoked
- Green card holders (LPRs) are somewhere in between, but refusing outright at the inspection booth is still not recommended
The simple rule:once you've cleared inspection and picked up your bags, these phrases are your tools.Before you've cleared, answer the routine entry questions, but still never sign anything you don't understand.
Three things you can do right now
- Save the four phrases to your phoneI recommend taking a screenshot or saving it in your notes app, or even putting it on your lock screen. When you're nervous, you usually can't remember these things, but at least you can pull it out and still understand it.
- Carry paper copies of your documentsRemember to bring your passport, I-94, and I-485 receipt (or documents corresponding to your current status). Getting asked to unlock your phone can be tricky, so bringing paper copies saves you from that hassle.
- Look up an immigration lawyer's phone number nowWhen you actually need it, nobody has time to sit there and slowly Google it.
